Drug Side Effects and Pharmaceutical Negligence

Prescription drug manufacturers have a responsibility to produce safe products and adequately warn users of any adverse side effects. In the case of the drug pioglitazone, marketed as Actos, a federal jury in Louisiana found that Takeda Pharmaceutical Company, Ltd, failed in their duty to warn about the side effects of the drug which is used in the treatment of type 2 diabetes. The result: an increased risk of bladder cancer, almost doubled in diabetes patients that took Actos over those who didn’t. The jury found that Takeda acted in reckless disregard for patient safety and awarded punitive damages of $9 billion dollars.

Further studies, ordered by the FDA, were delayed and indications of the side effects were ignored by the manufacturer. There were even findings that Takeda destroyed evidence in an effort to keep the findings from regulators and the public. Further action regarding Actos will certainly continue as there are some indications that the side effects may also include an increased risk of heart attack, congestive heart failure, heart disease and death
